I was the Buyer’s agent for the sale of the Kirby’s home referenced in the above review. I felt the need to rebut their review, as it is not at all accurate. The very first time the Buyer’s and I viewed their home, the Kirby’s were present. Mr. Kirby showed Mr. Buyer his detached garage during the first showing, and at that time, Mr. Kirby told Mr. Buyer that the firewood and the propane came with the house. Mr. Buyer mentioned this to me right as we left the home, and I thought that was very nice of Mr. Kirby to offer that as included with the sale. A Propane tank addendum was signed by all parties specifically stating: “Seller hereby agrees to notify Propane Company to read the meter at a time to be scheduled within 5 days of close of escrow so that the Propane Company can calculate the pro-ration and credit Seller the balance remaining in the tank.”

Seller did NOT notify the Propane Company prior to close to come out and read the meter and because the Buyer was under the impression that the Seller was giving them the propane, they didn’t question it, and thanked him for it when the transaction closed. It was at that time that Mr. Kirby called both agents involved in the transaction and tried to intimidate and bully each of us yelling that he never agreed to that. Then he called Mr. Buyer and indirectly called him a liar, saying he never said that. He said the tank came with the property, which makes no sense as the tank is rented, not owned. The Buyer didn’t want any problems, so he agreed to be billed for the propane.

This was just one of MANY issues Mr. Kirby had with the transaction. He didn’t like the home inspector, the electrical inspector or the roof inspector. In his mind, none of them knew what they were doing, since they all found issues with his home. Mr. Kirby hired an unlicensed “handyman” complete all agreed upon repairs, but when most of the roof repairs weren’t done, he flat out refused to pay the roof company to have the work completed, per the contract he already signed. He yelled and bullied his own agent over this issue, and was ready to back out of the transaction because of it, as it was fine as far as he was concerned. No matter how many ways his agent tried to nicely explain it to him, the agent was WRONG and he was RIGHT. There was no reasoning with him or having a civil conversation. Mr. Kirby would yell or bully to get his way, therefore his agent was forced to pay Mr. Kirby’s contractual expense to have all the roof repairs completed in order to appease him.

This is the first time I have worked with Tom Roslee with ReMax Gold-Pollock Pines, and I found him to be very honest, efficient, and knowledgeable. His ethics were beyond reproach. He was on top of every detail and did his best trying to pacify a VERY DIFFICULT seller, who was extremely unreasonable about many aspects of the transaction after he agreed to them. I have to say, I don’t know if I could have held the transaction together as well as Tom did, while being bullied so often by Mr. Kirby. Tom did NOTHING to warrant being treated like that. Unfortunately, it’s very difficult to deal with people that won’t take responsibility for anything, who always feel they’re right and have to get the last word in by yelling, intimidating or bullying someone else. That was the case with this transaction. There was no reason that Tom should have had to pay them for their propane when they didn’t take responsibility to have the propane company come out and read their meter prior to close, AND he had already had to pay for all the roof repairs, which wasn’t his responsibility either. Tom has a great reputation, and this one bad review from clients that only post bad reviews shouldn’t hurt that and the years he’s taken to build up such a stellar reputation, so please give no credence to the Kirby’s review.

I can only tell you our experience with him. When he came to the house to list our home he brought his wife who is not a realtor. She was practicing real estate by trying to convince us our house wasnt worth wbat we were asking and comparing ours to other homes she liked more. Tom simply allowed her to talk. We did list with him and part of the paperwork was a document for propane reimbursement. There was approximately $350 of propane left in the tank. Somewhere along the line the buyer convinced his realtor that my husband told hin the propane was included in the sale. His realtor told Tom. Tom didntl tell us. I kept asking Tom when we would settle the propane and he kept saying at closing. Closing came and went so I called Tom about it and he asked for our forwarding address to send the refund. Later that day the buyer texted "thanks for the propane". When I asked Tom why the buyer thanked us he said because we gave it to him. We finally cleared things up with the buyers. So Tom lied to us up until he got his commission. If the buyer hadnt said thanks we would have kept expecting a refund that never would have come. I have a text from him stating he had no intention of sending money for the propane.
