My friend has complained multiple times about her downstairs neighbor smoking marijuana. It smells every time I visit and my friend is terribly allergic and has respiratory illness. The manager has neglected to take care of the situation even though it violates the lease.

Curious how a property can ask a tenant to vacate the unit they’ve leased when the individual hasn’t broken or violated the terms of said lease?

Called and spoke with Lori and was not provided a direct answer as to why a 30-day notice was issued other than one roommate complained about the other possessing a registered gun inside the unit (which is legal in Arizona so I’m unsure where the problem lies), while the same complaining roommate illegally tattooes customers for money without a license or permission to perform commercial services out of the same unit.

If it is acceptable to terminate an individual’s lease because they possess a legal firearm inside their unit—and the lease does not directly address the inability to do so while living on the property—then I suppose once this is taken to court I will find out I’ve wasted my time and money on a fruitless endeavor. However, if we are to avoid that, the broker Kim Thorn should find a way to address this issue taking place at the units on Gail Gardner Way asap since there doesn’t seem to be a feasible way for tenants to contact her directly.
